Of the crew of Schn. “Lilly Beatrice lost near Bacalieu
Island May 25th 1915
By this public Instrument of Protest. Be it known and made Manifest unto all whom it doth or may concern, that on the Twenty sixth day of May, A.D. one thousand nine hundred and fifteen, Personally appeared at the Office of Alfred Penney, of Carbonear, in the Island of Newfoundland, a Notary Public by lawful authority, duly admitted and sworn, Matthias King, master and Guy King of the crew of the late schooner Lilly Beatrice of the burthen of 23 tons or thereabouts, belonging to the Port of St. John’s, Newfoundland
Who solemnin declared,
That on the 25th day of May instant at 4 am these appear and the rest of the crew of the said schooner set sail from St. John’s bound to South West Arm, Trinity Bay, laden with provisions and general cargo.
That they proceeded on their voyage with fine weather and moderate S.S.E. wind.
That at Cape St. francis ice was met and they hauled up in Conception Bay to get around it. They then had clear water or very scattered ice until they got across the Bay to about Lower Island Cove. There the fog set in thick and they met thick ice, shortly afterwards they heard the fog horn on Bacalieu, they hove around and stood off a bit and cleared the heavy thick ice when they again made towards the fog alarm . About 10 or 15 minutes after this the weather being still thick they struck a pan of ice smashing in three plank on the port bow. The schoonerbegan to fill and the crew jumped on the pan. She passed the pan two or three times the length of herself when she sank. Nothing was saved. The crew were taken of the pan of ice by another schooner that was nearby and were landed at Carbonear on the morning of this 26th day of May.

And these appearers further declare, that at the time of the said schooner Lilly Beatrice leaving St. John’s and also throughout the trips or voyage in which she had been engaged, she was tight, staunch and strong, well manned, equipped and provided with all the things necessary and essential for a schooner of her size and burthen, on her intended voyage, and the said Master on the day of his arrival in Carbonear appeared before me and noted this protest.
Thereforenthe said Appearers have protested and by these Presents do solemnly protest all and every person or persons whom it doth, shall or may concern in any manner or way, for all losses, prejudices and interests, costs, charges, damages and expenses already suffered and sustained, or that shall or may be hereafter suffered and sustained by the Owners of said schooner, for, by reason or on account of the premises aforesaid, and which losses, costs, charges, damages and expenses shall or may be recoverable from and against Underwriters and others concerned in time and place convened and as of right appertains, such losses and damages having happened and occurred as aforesaid, and not having been occasioned by or through the neglect of any of the said scooner’s company, who and every one of whom did their utmost for the preservation of said schooner.
Whereof an Act being required of me, the said Notary, I have granted these Presenters, under my Notarial firm and seal of Office, to serve and avail as need or occasion may require, and the said appearers have subscribed their names in my presence on the day and in the year aforesaid.
